What is the name of your state? New York... I booked (9) first Class tickets to Puerto Rico last year, for a Feb 2008 trip. The tickets were for my children, myself, my babysitter, and (3) friends of my children. In Dec of 2007 Delta Airlines called me, at least 5 times, asking me to give up my seats. They told me that the plane was oversold and they needed volunteers to give up their seats. After changing some plans, I was able to give up (3) seats with a value of $2800.00. Delta informed me that they would give me a voucher, worth $300.00, for each seat that I gave up. The vouchers were in addition to the full value of the tickets. The only condition was that the vouchers and tickets expired in one year. I was told that anyone could use the vochers/tickets.

In March of this year, I tried to book a flight to London for myseld and a friend. Delta would not honor my tickets. They said that they were only good for the named party on the ticket. No changes were possible. This is contrary to what I was told when I gave up the seats.

Being a Delta frequent flier, and a skymiles credit card holder, I contacted AMEX, and was told the same thing.

I would like to take Delta to Nassau County Small claims. I reside in Nassau County, New York. The woman at the small claims office told me that they cannot accept my application because Delta does not have a Nassau office. I know friends that had their cases heard there, and those plaintiffs were internet sellers that were out of state.

Does anyone know the best way for me to proceed?

Any help would be greatly appreciated.

All I can tell you is the court clerk should NOT have rejected your filing. You can certainly argue that the court has jurisdiction since the contract was entered into on your home 'ground'.
Of course, Delta could file a motion to dismiss and the court could hear the issue, but that would be up to the court on hearing both sides, not up to the staff.

One option.... call, don't email, Delta customer care in Atlanta (call 800.221.1212).
