What is the name of your state (only U.S. law)? New York
My supervisor met with me a couple of days ago to get my thoughts on whether or not I thought my job was working out. We have had discussions over the last few weeks about my performance not being acceptable. I did admit that I did not think it was a good fit. She offered me a mutually agreeable alternative to fill an empty desk and see how it works out. The position is a lower title, and no discussion of a change in salary took place. Today, she asked me for a letter acknowledging that I agreed to the alternative situation. How should I word this letter?
 


I would write that you agree to accept the position if and only if you are paid the same as you were in the previous position.
 
If you do not clarify with her that your pay won't change, it is likely it will if you enter into this agreement without discussing it first, so make sure you do. Why didn't you bring this up when you spoke to her?

Please note that fabulous07 is not an expert in employment law.

You are not in a position to be making conditions just now. Rather than the above suggestion that you "agree to accept the position if and only if you are paid the same as you were in the previous position", I would suggest that if there has been no discussion of salary, you either discuss it with her first, or else that you simply indicate, in the letter, that it will be at your current rate of pay (no "if and only ifs") and see what they say. You can always re-write later if there is an issue.
 
excuse em mwa... but who are you to speak of what I know and do not know? Besides, you just totally restated what I just said in different words, so your advice is the same or you just copied me. That was real unique...

How can you insult my intelligence and agree with me at the same time? Especially when you know nothing about me or my education... lol.
 
cbg - come up with your own advice, don't just restate mine.... I have already told the OP to clarify the pay with his employer, no need to restate that :) thanks.

I offered an alternate suggestion as well. You don't tell me how to post; I won't tell you how to post.

Your previous postings make it quite clear that you are not an expert in employment law. If you were, you'd know why I say that.
 
You insulted my knowledge and intelligence of which, you know nothing about and then totally agreed with my advice only rephrasing it. I am not telling you how to post, but you really shouldn't speak of things you know nothing about such as my education and knowledge. Your post was kinda funny to me, offering nothing new to the OP...

Where did I insult your intelligence? Stating that you are not an exeprt on employment law, which you are not, has no bearing on your intelligence. As for your knowledge, your own posts speak to that.

And I did more than "restate your response". I will grant I repeated a suggestion to discuss it with the manager AS ONE ALTERNATIVE; however, I provided an alternate wording to yours and in fact, strongly suggested that your wording NOT be used.

The fact that you would suggest the wording you did is proof enough that you are not an employment law expert.

Do you REALLY want to get into a resume pissing contest with me? Because I have no qualms whatsoever about putting MY qualifications to answer employment law questions out front.
 
you can't even spell expert correctly. i do not care about your resume because you can't even spell. i just gave the OP good advice that you even concur with... why don't you spend more time displaying your "divine knowledge of employment law" and less time trying to compare resumes with me... thanks.
 
i sense that someone feels inadequate or in need of comparing himself to others for his own esteem, very sad. that is ignorance in itself.

I see, you've never made a typo in your life.

Well, for the OP's knowledge, I have 30 years experience in benefits and hr management, including owning my own consulting firm at one time. I still consult and contract in that field; I passed the SPHR exam in 2002; I currently sit on the advisory panel of a nationally distributed employment law newsletter, and write a weekly column for an internet based newletter on the same topic. Among my previous contract clients are the 10th biggest law firm in the US and a major university in Cambridge, MA.

And your credentials are? Surely you want the OP to be able to judge how much better equipped to answer questions you are than I.

I see that you have adapted your initial response so that it now matches MY suggestion.

The OP is free to draw his own conclusions as to whether fab is not making a similar disclosure because s/he is so secure in his or her qualifications that they don't need stating, or because s/he doesn't actually have any.

Over to fab for the last word. I think I've made my point.
 
I gave the same advice as the guy with the huge trophy case, lol. Funny how he made this all about himself and his accomplishments. You aren't on a job interview dude and no one asked you, but I bet you had fun bragging and patting yourself on the back. I am a humble person, but a guy with a huge trophy case at home and claims to be an expert, just repeats the advice I just gave, then what good was your education since you still haven't proven you know something I don't.

I hear a man crying out for attention and no life, but to try to display his "superiority" in a public legal forum, wow. pretty darn sad.
