Situation (State: California)
I work for a media company and we're are going to be sending a young artist on tour soon.

I was asked if I could tour and I agreed. My position would be a videographer and video editor.

The same week the tour manager and the person 2nd in charge to my boss tell me they don't trust me with a 1700 lense. Prior to that the tour manager had made at least 3 comments regarding where I was from and saying that my kind are natural thieves and skilled in that trade alone. He also suggested that we make areas turn to bad. I did tell the boss this after I realized they were no longer joking. He said that they were joking and I shouldn't take it seriously but he will be sure to listen.

I know the 2nd in charge and the tour manager are good friends now. The tour manager is best friends with our boss/the owner.

I've now been told I've been denied the tour because another friend who is a professional photographer (not videographer) offered to do a month long tour absolutely free of charge.

They are now also avoiding speaking to me to discuss alternatives or anything. I need to speak with the photographer who is filming the tour because I edit the videos and am forced to create content. He needs to know what I want in order produce the videos.

My question(s).
If I'm fired do I have a case?
Do I have a case now?
Can I be removed from my project/job legally by someone who offered to do this for free? And they are a professional.

I tried to keep personal things out of this. Personal side notes here:
I do feel like I might be fired soon another co-worker was caught facebooking bad things about my videos and suggested people talk bad about the videos. I handed that information over to the boss as soon as I saw her suggesting that her friends start adding trash comments. What is the name of your state (only U.S. law)?

Are you talking about your race or your national origin?

If you're fired, you may be able to file a claim with the EEOC if you can provide evidence that you were fired specifically because of your race, and not for any other reason.

As to whether you have a case now, first advise us what your damages are. (And no, simply not being allowed to go on a tour is not damages.)

It is possible he was joking, although it was a poor joke to make.

He said that they were joking and I shouldn't take it seriously but he will be sure to listen.

You complained and the boss said he would be attentive for any other similar comments. Presumably he will deal with the sitution if there are.

And your employer wouldn't want to take advantage of that because??? Of course they can give the assignment to some else willing to do the job for free.

I don't see that you have any claim to make nor any indication that you're about to be fired. I understand the remark was in poor taste and you're disappointed about not being able to go on the tour but you're on the verge of making a mountain out of a molehill.
