Wondering if I can do something about this?
I am active duty military and I receve allowances(housing, sustinence and uniform) with my paycheck that has to be directly deposited into my bank account.
My problem is this a CA obtained a judgement against me without my knowledge. A summons and subsequent court paperwork had been sent to my old address. I am good about filling out change of adress forms and the like so it is not like I am that hard to find. I find out about this judgement when they froze my bank account. I am a single mom and needed the money so I had to borrow it to pay them off so I could make rent.
I went to my old address(the one the court had on file) and talked to the lady who lived there. She said that they they left the summons on her doorstep after she said that she did not know who I was. She did not know me from adam so she just threw it away. I moved from there 2 years prior to this "service" and the courts have sent mail there as well.
The court file said that proper service was obtained and a default judgement was obtained.
Can I don anything about this after the fact(paid them off 2 months ago)? Also what is exempt from garnishment or does it even matter as they just took whatever $$ was in my acct. I don't know anything about military allowances and am reluctant to take this to my command as you can get administratively discharged for indebtidness.

You might want to post this on the military forum. Contact an attorney and see if there is a means to set aside the default judgement based upon the improper service and error.
