What is the name of your state (only U.S. law)? VA

My wife was recently laid off from her teaching job (2/28/09). She worked at a school that was run by a church. Apparently the school ran out of money mid-year and ceased operation. My wife then filed last week and we received a denial letter from VA stating "Benifits Denied. No Record of Covered Employment in Base Period." Come to find out, the school has not been paying their unemployment tax for the last few years that is why apparently every teacher has been denied for this reason. Is this actually legitamate? It does not make sense to get denied for the fault of an employer when taxes are taken out of the employee's paycheck each month. Is this something I can fight? I appreciate the advice.

Churches are exempt under the law from paying UI.
