I live in California. My dental insurance company sent a notice to my dentist stating to reduce administrative costs, duplicate x-rays will no longer be returned. I have an insured group dental plan through my employer. Can the insurance company throw away medical records such as x-rays? My dentist states that the cost of duplicating any x-ray will fall upon the patients. Since the insurance company is no longer returning x-rays, are they now responsible to provide benefit for these additional costs? I don't think this cost should effect my yearly maximum or the limitations of frequency.

My dentist submitted a pretreatment estimate to the insurance company. They requested a copy of an x-ray. My dentist provided the duplicate after charging me a fee. The claim was denied. My dentist requested a reconsideration. They are now requesting another x-ray because they threw the first one away.

Please advise. Thank you.
