What is the name of your state? Florida

My son (AD Marine, stationed in South Carolina) claims, through the military, his daughter as a dependant, this is to allow her to be registered under DEERS for medical benifits, etc. He is the biological father and pays child support. Has been this way since he graduated Boot Camp in Nov 07.

The ex-girlfriend whom he has the child with is now married to another service member. My son is being told that, her husband (AD Navy, stationed in South Carolina) is now attempting to claim the child as his illegitimate-dependant under either DEERS or through the military. Her husband has been in since Nov-Dec 09, and is still undergoing Sea School.

Never heard of this before, but then again I am married to the women I had children with, so I don't know.

My son (Currently in his advanced MOS school) was told by someone (Who? I've yet to find out) that this is legal and that once this occurs, he will lose his BAH Differential and be required to pay back the money he has received thus far.

Does this sound legal, correct? Or is this someone blowing smoke up his back-side? Sounds to me that there is some "Barracks Lawyer" feeding his Ex-GF and her husband some BS! Then again I can be wrong here and this is legit.

Smoke is being blown. If your son has the court docs showing his obligation to pay child support he'll be fine. The kids will be linked to your son and the stepfather in DEERS, but it won't affect his BAH. Google "dual eligibility in DEERS" for more info.
