Dear All,

My wife contributed $5000 towards 2016 DC FSA account and quit her employer in december of last year. We were out of country on personal emergency and came back to United States in March 2017. As soon we came back, realized that run out period to file a claim was ending soon and tried to file claim reimbursement using BofA benefit solutions online claims module. But i got a module under construction message everytime i tried to access and raised a help desk ticket for the same. After giving them 24 hours time, i called their help desk number and was told by their customer care rep that dead line to file is March 31st and i don't have to worry. This happened on March 15th 2017. He said that i will have access to the claims module in 24-72 business hours. I waited patiently and called them back on March 20th as i still did not see the fix with claims module. Now BofA benefit solution folks are saying, I missed my deadline and i cannot do anything. This is just ridiculous and everytime i call, it's a wait time of 45 mins to 1 hour to get hold a customer care rep.( I am not kidding, right now i am on hold on both mobile and work phone for the last 52 mins).

Is there anyway i can appeal this and submit my case to get an exception from employer ? I have all help desk tickets that i raised with benefit administrator. Apart from that how can i get this mess handled ?

All you can do is address the situation with your HR/Benefits department and see what they say. If you are asking whether there is a law you can invoke which will require the employer to authorize an extension, there isn't.

This is not to say that they will not help you. If you worked for my employer, I am the one you would talk to about the situation. I would say there is about a 95% chance that under your specific set of circumstances, we would authorize an extension.

But I cannot come up with a way that your employer would be REQUIRED to allow it.
