I live in California. I was in the market for a used car. I found a Subaru that I liked, through the newspaper. The car needed work done to it, but the seller said that he would have all this done for me. I even took the car to my mechanic, and he told me everything that was wrong with the car, and I relayed this info. to the seller. He said that he would take care of all that, but he would need a deposit. The selling price was $2950, so on 8/30/2000, I wrote a $200 deposit check (I wrote 'deposit for Subaru' in the Memo section of the check) Meanwhile, I found and bought another car. When I contacted the first seller to get my deposit check back, he refused! Saying that he could have sold the car - over the weekend - but didn't because of my deposit. He also said that all the repairs were done. (his words, I didn't see) And he cashed the check that day before I could put a stop payment on it. Doesn't he have to put in writing that the deposit is nonrefundable? Have I waited too long to try and get my money back?
