My wife and moved in to a rental property from out of state(rental property located in Syracuse, NY), that a relative had found for us. We found the house to be unsuitable, and on the 6th of the month met with the landlord to sign the lease, a month by month lease, which stated the lease could terminated by either party by notifying the other prior to the 1st of the last month of the lease.. I told her at that time that we did not intend to stay there beyond 1 month, and made a note of that on the lease when I signed it. She verbally agreeed.

At that time she had received the 1st month's rent and an additional check for a deposit equal to 1 month's rent. She is not returning my phone calls and has not returned our deposit. We moved out on the 9th of the 1st month we lived in the house. On the 15th she came to the house and removed a few items we had left. When I came back on the 19th to get the items they were gone and she had sent a letter to my relative stating that the items were our loss as we had not removed them by the 15th of the month.

What can I do to get my security deposit back? Should I contact a lawyer or do I have no chance?

why do you people not be exact with dates, 1 st of what month the 9 and 15th of what month...

do you have a copy of the lease?

what dates was the rent paid for? was it paid for on the 9th and 15th and the 19th?

did your relative get a letter from the landlord? what date was it postmarked? and why the 15th?

The rent was paid for the month of April.

We moved in 4/1.

We met with the landlord, had the conversation about only staying one month, ammended that to the lease and signed the lease on 4/6.

We moved out on 4/9.

On 4/15 she removed our items we had left.

She sent a letter to my relative in Syracuse on 4/13 stating

1. I was to stop calling her at work, if I had to tell her something, it should be communicated through written letter.

2. Our items would be removed 4/15 if we had not picked them up.

You probably will have to hire a lawyer since the rent was paid for april she had no legal right to enter and remove your property.

You should write to her but you might as well call her at work saying you will get a lawyer, and file criminal charges against her if your stuff and the security deposit is not returned immmediatly.

Which you should have done on the 19th when it was gone, you shoulda called the police and filed a report.

A landlord has FULL Legal responsibility for the tenants belonings in NY if they remove them from the property.

Gather reciepts, make a list of whats missing, and go get the biiitch!
