Deposit Question

What is the name of your state? California

I moved out of a room I was renting last June. The landlord said he would pay me back my deposit. I called him about every other week and he says he'll get back to me. I gave him my address and met with him and he said he'd pay me back, but never does. I plan on writing official letters to him. The problem is I lost the agreement we signed. Can I still file for small claims court without the agreement? How long do I have to file? It has been 9 months now, but we have been in contact.

He was supposed to send your deposit (or an accounting of deductions) within 21 days! Take him to court now!

I was able to find out the contract we signed. That's a relief.

I sent him a letter to pay up or I'm taking it to the judge. I hope the letter shows that I mean business.

One of my other ex-roommates is have the same problem but he doesn't have his contract. Should he file?
