I evicted tenant for non-payment of rent since January. Tenant claims thermostat was not working properly but city inspectors she called dissagreed.
Judgment was entered for 2 months deposit only (no late fees, court cost...) in my favor.
Tenant wants her full deposit back. She has not paid for the 2 months yet but have moved out. I have 30 days to return deposit.
Question: can I deduct court cost? late fees per lease agreemant?
she also filed appeal - so we will be meeting back in court again.What is the name of your state?What is the name of your state?

READ VERY CAREFULLY....you itemize all of the property damages - cleaning, etc FIRST, then whatever costs/rent:cool: were NOT granted in the judgement and THEN you apply any remainder to the outstanding judgement.....do your calculations EXACTLY in that order and provide the itemization within the appropriate timeline.

If you don't have a forwarding address, mail it to your rental address WITH Address Service Requested under your address in the LH corner....that ask USPS to let you know if there is any forwarding order in for the tenant....if not, the envelope will come back to you and you keep it UNOPENED....if it is forwarded, you will get notification and have to pay a small fee to the USPS for the tenant's new address which you will need in order to go after your judgement.

Do not forget to take pictures of the damages and messes related to cleaning. it helps LLs as well as tenants to show a judge pics of conditons left at the end of tenancy.
