Good morning all! I have the dept of motor vehicles in this state trying to get me to give them 49,000 and some dollars in surcharges that they have been compounding since the 70's. They say that I could just make payments of 4,300 a month or just pay it in full if I would like to. :eek: I have called them to try and negotiate the numbers but I always get someone on the phone that "can't help me with that". I spoke with an attorney in my area and he said I might be able to file a bankruptcy and not pay a thing to them. I get their letters that say that it is going to collections and they are gonna seize my property and garnish wages and destroy my credit and kick my dog and so on and so forth!! :) This does show up on my credit report and here is my big question! I want to get married, my fiance has a house in her name, she is worried that if we get married that this lien that they threaten me with will damage her credit and drop down on her, us, and the house too. Does anyone know if it will?? I have credit cards, but nothing else in my name wotsoever. Bankruptcy seems like a pretty good choice so far. Would that hurt me if I file for it and then get married while doing so??

This is the end result of many years as an out of control, drinking and drugging, selfish and stupid, immature behaviour. 10 or so years ago I decided to choose life instead of death, where I was headed. I had tickets all over this state and was running from everyone and everything. I hired an attorney and contacted every court and faced up to all the things I had done. It cost me about $70,000. in fines and Legal fees and I did 7 months in jail. That was a real drag but a small price to pay for all those tickets. (drunk driving mostly) I have changed all that since then and I work hard at my biznez as a remodeling contractor. I said I wanted to negotiate with them but they don't want to . Chapter seven seems my best choice so far. I pay child support for three kids and pay the bills and take care of my fiance and her two kids too. I never miss a payment on anything and haven't in years. I just want to end all this legal stuff that is still following me and get married to this wonderful woman I have found but like I asked, will this hurt us and her if we get married with this stuff over my head? If your name is nowhere on HER property, then NO ONE can touch HER property, period. Same goes for her credit - the two do NOT suddenly mix just because you get married, that is such a myth people keep spreading. You are EACH SOLEY responsible for your OWN debts, your own credit reports, and your own assets.

The ONLY time anything could wash over to your fiance is if the two of you got joint credit or if she put your name on her deed. She is safe from your past.

You might want to speak to a bankruptcy attorney to find out of those charges from the state will be dischargable. Some debts are not dischargable, and debts caused by criminal or illegal activities are that kind of a debt. It it turns out that the 49K is not dischargable, then you'd probably be looking at a Ch 13 plan. Only a NJ bankruptcy lawyer can tell you for sure, so go for a couple of free consultations and see what they tell you.
