What is the name of your state? CA.

Excluded from a list of alternative contacts in my immediate supervisors absence. (All other managers were included on the list and they were all of a different race than me).

Requests for an expense account ignored. (later found out that all of the other managers had expense accounts and they were all of a different race than me).

Was not invited to attend high level meetings were discussions regarding my department were taking place. (Other managers were in attendance and they were of a different race than me).

Constant negative comparison to other managers (of a different race than me). Historical performance records would show a consistent pattern of out performing those individuals that I was compared to.

I know I've responded to your situation before and not long ago, at another web site.

The issues remain the same. It's just not possible to say with certainty whether prohibited discrimination was a factor. You are free to file a complaint with your State's equal rights division, the EEOC, or consult with an attorney for a legal assessment as to whether you have the basis of a claim.

You can be treated differently in spite of your race, just not because of it.

Yes Beth3, you have, although I provided a bit more information this time. I am not soliciting for absolutes but simply establishing the footing for my case. Your advice and others on this site are helpful in that pursuit. I do not contend that I have a "slam dunk" The particulars of my situation are subtle and thus will require more work on my part to reveal.

Are you of the opinion that all successful discrimination cases are in your face and obvious violations or have there been cases were discrimination claims have been proven despite less than blatant evidence?

Nope, I'm certainly not of that opinion but I am of the opinion where the discrimination may not be overt that the ability to provide and receive pertinent legal input in a forum such as this is extremely limited.

The best answer you are going to be able to receive from any responder is "maybe." You may of course post your question on as many web sites as you like and solicit as many opinions as you like but until you see an employment law attorney who can elicit all the pertinent facts and analyze your situation in detail and in depth as to whether there are sufficient elements to demonstrate that prohibited discrimination occurred, I don't see where this is going to get you.

May I just add that if you were treated less favorably than your peers because of your race, I hope you avail yourself of your full rights under the law. Good luck.
