How do I start proceedings to Petition for custody of my two children, who were taken into custody when my husband was involved in criminal activity, and the inaccurate reports of my childrens presence or that it occured in our home resulted in DFCS getting involved. These reports were false, and me and my children were out of town. This can be proven, without a doubt. They later had me arrested for "Interstate interference of custody," and placed me under a hold, without bond, for 8 days. I've been convicted and sentenced, and later found out that they had no grounds for these charges, and had no order on file until July 13, 2004, two days after I was arrested. The order was not put into place by a Judge until August 18, 2004. This is just a brief description of my case, but it would take quite some time to fill in all of the details, so I will wait on a reply, and be happy to tell the rest. Custody has been given to my brother and his wife, and we need to know how to transfer custody back to me, and return my children home, where they belong. PLEASE, help me

I had an attorney, but I really believe he hurt me more than he helped me. I was just hoping to find out the procedure, so I would know what to expect from my lawyer when I am able to hire one. I really can't afford to pay another one, without knowing what to expect or what I should do to accomplish this custody change.
