If the CP has been frustrating the NCP's access to the children, can the NCP just go and get the kids without the CP's consent? As long as the NCP lets the CP know the whereabouts of the children, will Calfornia state law allow the NCP to take the kids without the CP's consent? What if the NCP wants to take the kids out of the country without the CP's consent?

If the CP has been interfering with the NCP's court ordered visitations then the NCP needs to notify the CP of their intent to collect children on X day at X time(in accordance w/the court order, of course) and if the CP again interferes the NCP will file a case for contempt of court against the CP......judge will give CP very firm warning and again re-enforce that NCP has right to visitation as provided by court order....happens again???....back to court -- eventually judge will get VERY tired of seeing CP in courtroom and will take more definative action against CP and enoforce visitation for NCP.
Do NOT simply collect children without notifying the CP - regardless of if it falls within your visitation time or not - this will put NCP on the WRONG side of the law and in a position to get in a LOT of trouble. Additionally, do NOT attempt to leave the country - or even the state - with the children against the CP's will UNLESS you have already petitioned the court and secured legal blessing for such trip or NCP may find themselves facing kidnapping charges and that will not help NCP's case when it comes to trying to get the courts to enforce visitation.
The only way to proceed here is to do it within the confines of the law - the CP is in direct contempt of court for not allowing the visitation as outlined in the court order -- the court will enforce it but you have to do it the right way. Would hate to see NCP wind up in jail for going about this the "vigilante" way....
