Determining Income from Military Pay

What is the name of your state (only U.S. law)? CA

I wanted to clear up some Child Support info that has been unclear on this site in reading past posts.

A judge absolutely can, and will, count any and all income when determining child support. For military members, this includes BAH, BAS, Extras like Flight Pay, COLA when living overseas...everything stated on your LES that you get paid.

I've seen posts that state only Taxable income (base pay) and BAH are included, but in my recent court experience, EVERYTHING - and I mean EVERYTHING - was counted.

Just wanted to share this for other in a similar situation so they can be prepared.

Hope this helps

That is not the norm, usually they will do, basic pay, BAH, BAS and COLA (if overseas). The reason is that most extra pays such as flight pay are not always every month of a year. They do not normally touch clothing allotments, Hazardous Duty pay either.
