What is the name of your state? Wisconsin

My husband and I have been separated for two months. He opened his own checking account. He owed me money for childcare. He said he didn't have all of it, but gave me a check for a little of it. I accessed his bank account with his social security number and found out his balance. He found out about it (I don't know how). Can this be used against me? Is this illegal?

OH YEAH YOU DID SOMETHING ILLEGAL! You cannot use anyone's social security number for any reason ,for anything, no matter what, without their permission, and then you still should'nt. How would you like if he did that to you? Hope finding out that balance was THAT important. Did finding out if he was lying get you anywhere?

My response:

You're forgetting, or are ignorant of, the fact that Wisconsin is a Community Property State. Read my response to her duplicate post, here:

He could find out my balance anytime he wanted to because I still use the one that was our joint account. He was supposed to take his name off of it, but never did.

Did finding out he was lying get me anywhere? Well, if I'd found out he was telling the truth I would have felt bad that I doubted him. But finding out that he was, indeed, lying helped me in my resolve to leave this abusive situation behind. In my mind it's despicable to lie to your wife and withhold money owed to her when you have it. He tells me that he wants to be with his family and that he loves me. Yet he lies to me and withholds money for our children's care. Did it get me anywhere? Well, further along the path of getting out of a terrible situation, emotionally speaking.

I didn't know it was illegal since we are husband and wife. If it is then I suppose there may be consequences, however since we are husband and wife I assumed that I had a right to know what his assets are.

My response:

Hello! Knock, knock!

Is anybody reading out there? You didn't violate any law, and "his assets" are "your assets" in a Community Property State. In other words, he's holding onto YOUR money, too!

So your saying using you spouse's ssn isnt illegal? I apologize I was always told that even if you were married to someone you cant use their ssn, for anything.

My response:

That's true - - with the exception of a spouse IN A COMMUNITY PROPERTY State. You have implied authority from him to use anything of his while you're married.

I am sorry that you were in a bad relationship.I think it sucks that he lies to you and hurts you. I commend you greatly, and have the utmost respect for you getting out of that situation, I know first hand how horrible and hard that is to do. But going behind his back, even though I agree that he deserves it, doesnt make you the bigger person, any withholding of truths is lying. Im sure I will get A LOT of flack for what I just wrote, but everyone else gets to state their opinion on here. I'm woman enough to take what you all have to say. Claire I again commend you for getting out of that situation. Not that many women are that strong!

My response:

Goddamnit!!!

Do you EVEN understand the concepts I've mentioned? Do you know what it means to have Community Property jurisdiction? Jesus Christ - - if the law in a Community Property State recognizes "apparent, or ostensible, or implied" authority, then she DIDN'T legally "go behind his back"!!

She did NOTHING legally wrong!!

What more do I have to say to make you understand these concepts of law?

Apparently, you live in a "Separate Property State", which may be the reason why you THINK she's done something wrong. Well, god-damn it, she hasn't!

My response:

No, the SS number itself, IS NOT Community Property. You're still not understanding. I'm saying she has his "implied" authority to USE that number to access the accounts in HIS name. That money is both of theirs - - despite the fact that he has a "separate" account.

My response:

You did, you little freak! And that's because you're making her feel guilty about something she should have no guilt for doing; e.g., by saying: "But going behind his back . . ."

Do you understand "implied" authority? If you have "implied" authority, you don't need to "ask for permission". Ergo, it follows, she didn't "go behind his back".

Learn to spell. There's no such word as "Noone". The words are, "No one".
