I had been taken care of my 5-yr old since she was born and Her father had never actively play his role except his $75 support while he was in school. I did not have a family that could help me with her at least at the time that we lived in NC. His grandfather had helped me tremendously when I moved to Chicago to pursue a better life for me and my daughter. When we finally got divorced he agreed to help me (as soon as he finished school) to take care of our child while I'm settling down here in Chicago. He said that he would make it up to me for all the things that had happened and that his family will always be there for me and our child. I moved to Chicago first week January 2001 he picked our daughter from NC to VA, dropped the child to his grandpa's house and immediately left for military training. He said that our daughter could stay with his grandfather for as long as it needed and that he would not file for a custody (he didn't want her in the first place). But right after he remarried and got kicked out of the military. he turned the table around. He filed custody for Alexis that was when I was ready to picked her up from VA to Chicago.
Last January we officially agreed to have a joint custody (daughter could stay with me, for all holidays and vacation or least while she's not in school. I was supposed to picked her up last January but me and my former spouse agreed that child could stay with me from April of this yr until at least January next yr( she wont start school until next yr) for exchange of dec holiday for next year ( he and his wife are going out of the country to visit her family). My lawyer even told me that she could stay with me until she started going to school. But after the Sept 11 attacks in New York my ex turned around again and filed this time for a sole custody of our child claiming that I refused to bring Alexis back to VA. He said I was violating the law he claimed he didn't know my address and telephone the time he is calling my house( he called me and his wife on separate occasion after sep 11 and wants me to bring the child back to VA for at least 2 weeks there because his wife is having a baby by Nov which I refused to do not just because of our verbal agreement but I just recently had a caesarean baby and was very hard for me not to mention my fears of flying after Sep 11. I will have to drive down there to bring her to VA and my husband couldn't just take a days off, and Christmas was fast approaching. I would never be able to bring her back here on time for Christmas. To make matters worse when I called my lawyer he denied or maybe just completely forgotten telling me that child could stay with me until she started school. He said that child could be 50 yrs old and not be in school. He was very sarcastic and I felt really bad about it.
But what about what me and my ex talked about? Should everything be written down on papers. And my lawyer??? he was the one that advised me to keep Alexis until school start. Please, I need everyone's advise. What should I do? My ex is taking advantage of the situation not to mention other things he had done to me. What procedures should I take? he already filed for sole custody but no hearing date yet. Thank you very much.
