Did Social Services over step their bounds???

What is the name of your state?What is the name of your state? I live in NYS.I rented to a couple for 3 years. The man moved out, about a week later the woman moved out. About a week after that the woman called and wanted to pick up some things left in the apartment. I left the door unlocked so she could get in. She locked herself in the apartment and refused to come out.She said she was not leaving and would pay no rent. She wanted me to serve her with eviction papers. Since she was elderly I called Social Services, Adult Service Division.In a few days they sent a worker. Also Office of the Aging meals on wheels started to come and bring food. They offered to take her out so she could shop, do banking and check mail since she received an SSI check.She would not leave the apartment they had to do all for her. I became the bad guy because I wanted my rent. I served her with all the necessary papers. Social Services told her not to pay she had 30 days. Social Services gave her a name of a Legal Aid Lawyer which she called. The Social Services worker along with the office of the aging worker took all the papers which I served her, took them back to their office and faxed them to the lawyer.The lawyer still has not even met her. Did Social Services and Office of the Aging overstep their bounds in this matter by being bias and taking sides????? :mad:

What do you mean, "did they overstep their bounds?" What are their "bounds"? You called them. What did you expect to happen?

In your estimation their actions indicated "taking sides"? As Coosi stated, what was your expecations when YOU involved them? Otherwise, if you have not researched your state l/l tenant laws do so and follow these laws in your rental procedures/eviction procedures.

For the last 30 days all I have done is been researching the landlord tenant laws in my state. It seems that the landlord has no rights. That person gets to live at my house for free, I have to pay the electirc , gas and heat. Social Services was called because she was a danger to herself and others. She would scream and bang on the walls at night, smoke in bed and never get out of bed. Locked herself in the house for 30 days, refusing to leave.Smoke alarms batteries taken out.They were called to help find a place to live where she could be cared for, not to tell her that she could stay until I had a court order to put her out telling her that there was no need to pay the rent and I could not make her pay the rent.
My question was do the workers have the right to take the legal papers which are served to her, take them to a government office and fax them for her personnel use in dealing with her lawyer.

Thanks for clarification. From what has been said on this thread, they not only have the right to do this, but also a responsibility, once they became involved in the case. I believe you stated she is elderly, she also sounds a little off mentally. Perhaps there is a financial assistance program she is eligible for that would pay her rent.

Another thought (and angle). The SSI might be for a mental issue, she sounds like she needs (or may already have) a legal representative who would take care of her finances (this is VERY common). The agency that is helping her could perhaps be of assistance to you as well. Might be worth a few phone calls...

I did call Adult Services several times about my concerns. I stated I felt she was unstable and a danger. The house is a small Duplex and a 5 years old child lives in the next apartment only a thin door seperating the rooms. The child could hear the yelling at night. He was taken to his grandparents house to spend the week during the Easter/ passover brake so he did not have to be subjected to the noise. I told SS that I was afraid she would burn the house down. I asked them who was going to pay the rent. They told me she would because she was collecting SSI and Food Stamps. All Social Services did was help her find a Legal Aid lawyer, come to the house get the legal papers fax them so she could get out of paying the rent. Nobody found it strange that she would not leave the house for 30 days. It has been so frustrating the last month that I feel I would like to sue the whole world.

Also, you need to check into the law regarding mentally ill persons and special accommodations they are to receive due to their disability.

This looks like a case for involuntary committment if she indeed is a threat to herself and others.

Be prepared for continued headaches.

Thanks anyway, I'm still going to check out the link. You never know, I might find something helpful. I feel that Social Services handled this very badly. And with the help of Social Services helping her find a new place to live now some poor soul has inherited the tenant from hell and doesn't know it yet. Just 5 miles from my house. This person still a danger and SS did nothing.

Oh I forgot to mention, SS paid $200.00 to move her few boxes to her new apartment, but would not pay me the rent. I called the police when she was leaving beacuse she started to flip out. They escorted her out while they shook their heads in disbelief.
