did the crime-got the time-but no money

What is the name of your state? Missouri

Pled guilty to first DUI, got 2 years probation, SATOP, WIP and 50 hours comm. service. First time in trouble, at 55 yrs., accepted this optional sentence to remove DUI from record in 2 yrs., no lawyer, of course. First, didn't realize judge meant supervised probation and I had no way to get to the town, not even the bus goes there and probation officer refused to transfer me to my county. Second, the programs total $900 and I am broke. Did my community service and paid fine, court costs and probation costs (almost $700). Now, probation is revoked, I'm due back in court in one month and have no money to complete programs by then due to being in a car accident (passenger, no alcohol involved). Okay, can I just ask for jail time in lieu of doing the programs? I'm getting an ulcer over all this. I don't have a vehicle and don't want my license back any time soon, just want this nightmare, that I have created myself, over. Any advice?

Okay, I received two answers. To the first guy: Although I love your quote, now I know where Confederacy of Dunces guy got his book title, could you elaborate, if you're serious? Yes, I can or Yes, I can but it won't work? I'm very serious and its a legitimate question that hasn't been asked before that I know of. To the second guy: I'm vegetarian, but I suppose I could as easily get a T-bone as a tofuburger. Seriously, can I do jail or will they just give me jail time until I promise to do the programs? Does it make a difference that I don't want my driver's license back? Will someone give me an educated answer, please? freddie1117

A: Yes, you can just ask for jail time in lieu of doing the programs. If you do the jail time, then that is your sentence and when you finish with it, you have paid your debt to society. They are probably tired of messing with you and if you would do your jail time and then go away, they would probably be very happy with that.

Thank you, senior judge, seriously. Not to tip a cow to death, but any idea how much time, approximately, I might be looking at (Texas County, MO)? Its just a side thought, cuz I'm going in on Dec. 3 and throwing myself on their mercy, either way. Last time, the D.A. read excerpts from my arrest report out loud and all the other "criminals-to-be" had a pretty good laugh at my expense so I already know what kind of mercy I'm gonna get -did the crime. freddie1117

In reality you may want to get this over with by serving time, but based on your county you get a certain amount you receive per day in jail. Most jails don't give a lot, and in reality you can pay that amount w/ a minimum wage job in half the time you serve. I would look into that before you give up your freedom.

Okay, seniorjudge, I thank you for your time and advice. My case has just been accepted by the public defenders office so, with any luck, I can get my probation transferred to the county I live in and some extra time to complete my programs due to being in the auto accident and out of work for awhile. If you want, I'll keep you posted. Otherwise, sorry if I seem to be so confusing. I'm hoping its temporary due to "brain bruising" which supposedly heals itself in time. freddie1117

Yes, alcohol is the drug that produces a lot of brain bruising.
