What is the name of your state? Kansas.

We filled out a form that we were told was used to get the financing started. Our offer has been accepted, (the house is empty and being sold by a developer) and and the form it said that closing was to be done by Feb 15. He said the bank was requiring that that be on there. Well, yesterday was the 15th and we didn't sign. So now what?

Q: So now what?

A: If your purchase contract said you had to close by the 15th, then you have no contract now. You can either renegotiate the contract, sue them for specific performance, or start looking for another house.

**A: you are contradicting yourself. If there is no contract now, how could the writer sue for specifc performance?

We want the house and have no problem resigning, but the guy is hard to get a hold of. We were allowed to move into the house cause our house sold and we were stuck. We were told we would close a long time ago, so we went ahead and closed on our house. Then the new house didn't close and we were looking at livingin our camper, so the guy told us to go ahead and move in. We have put some money into the house because a few basic things needed work, but withheld doing anything major.

I do not want to take it to court, but wonder if there is some legal grounds that I can bring up to the guy in hopes of getting his butt in gear! If that doesn't work than I would be willing to take it as far as necessary. We only put $2000 down until signing, so we aren't out a huge amount, but it is the principle.

What are specific perfomance?
