I recently won a small claims suit (Connecticut) for back rent. The tenent filed a counterclaim but never showed up for the hearing. He made four payments before I got a letter from his new lawyer stating that he never got the mail from the Housing Session informing him of the court date! He is lobbying for a "set aside" on the payments. Now I have a new hearing to go to. He has already been evicted. Is there any way to prove he did or didn't get the letter? It was sent by the court. I can document several lies over the past months. Is that enough to convince the court that he is probably lying now? Or do I have to go thru the small claim procees again, this time against a lawyer (which, honestly, makes me a little nervous even though I am right).
