Difficult tenants

What is the name of your state? Oakland, CA

I have a complicated situation, so I'll try to outline it the best I can.

Tenants moved in mid-Feb '06. They were suppose to pay $1500 in security deposit. Made the mistake of not collecting cash or money order. They gave verbal agreement we would get it by the end of the week. February was prorated for $800. We got that right away. Tenants realized there was no heating upon first night there. I was unexperienced and didn't check local health and safety codes. This is my first time being a landlord. Tenants witheld rent for two month until unit was fixed of all problems. I felt bad I put a family in a bad situation, without heat and proper electrical, so I made the necessary repairs. Since early May the unit has been in working order, but they still won't pay rent. They keep telling us they will, but they never do.

How can I evict them and still get past due and current rent? Any help would be appreciated.

We're not going to advise you, and guide you, through the eviction process and collection process. So, get to your local bookstore tomorrow and buy a book on the subject.

Well... no we will not go thru the entire process with you but I do not mind giving a little guidance to a wet behind the ears landlord that stepped into our parlor.
