Does the insurance company have the right to send you a letter telling you, you have 4 months to put a new roof on your house by a contractor or they are cancelling your insurance. Mind you 4 months.

I have had nothing but problems with this insurance company and been with them for 20 years and what is my legal right here.

Department of insurance wants the letter.

generally, yes, if the integrity of the roof is compromised to the extent that it can allow damage to other areas of the house. Of course you would expect them to cover damage if the roof collapsed, yes? If so, look at it from their perspective; they merely want to mitigate any damages there may be and save themselves some money.

Of course they can. In most states they can cancel a policy with about 2 weeks' notice. 4 months is a LOT of time. Remember, you don't HAVE to fix your roof. they are simply notifiying you that they will no longer offer insurance. You can buy it elsewhere. But, expect that the new company, should they choose to inspect your home, will also set up it for cancellation. Your company is simply not going to renew your policy. How long you've been with them is irrelevant.

sad thing only one spot bad on roof, tiles, which is storm damage, still under warranty and threating and harassment from your insurance company is illegal. Not to mention found 4 house roof 3 times worse than are and they didn't get a dirty letter from the same company! I have found that out.;) Contacted my contractor whom put our roof on. We need reform on all of these Insurance companies! Biggest mistake the government made was to make it mandatory! They have gotten too greedy and want your money but not your claims!;) Loose your claims time 3. Which should have been grandma in is what we were told by other companies. We will repair it not a problem but gone around about it the wrong way!

I think it is best to file complaints with Department etc. Our vehicle insurance is Grandma in why they don't do the houses is bull crap and change your deductible is reductulice!

How is sending a letter "threatening and harassing"? Also, they don't inspect every property every year, and each property may have a different inspector. The government has NEVER made homeowner's insurance mandatory. You don't want home insurance, then pay off your mortgage. The rest of your statements aren't in English, so I can't begin to decipher them.

Insurance companies do not have to insure you. it is not "illegal" to say they want there clients to take care of there risk. some companies are pickier then others. if you feel harassed then move your business. If they didnt want your money but was happy to take all your claims nomatter how small, how would they be in business? its a busness not a charity.

Not that I agree with all the underwriting guidelines, or recent action by some companies, but this is a tiny problem. Imagine they told you you were suddenly too close to the ocean after 30 years. and then cannot find any coverage at all. now that is a problem.

I've read this three times already and I have yet to find the "dirty bird". I was thinking there would be some reference to bird poop on the roof.

For the OP, this letter just didn't come out of the clear blue sky. There has to be some existing issue with the roof.

Your options are
  • Replace the roof
  • Find another insurance company (who will probably want a roof inspection)
  • Pay off your mortgage and self-insure

BTW, DOI will look at the letter and ask the insurance company to respond (which they will.) Then DOI will tell you, in a circuitous sort of way, the insurance company's demand stands and for you to replace the roof if you want to remain insured with them. This whole process should take around four to six months to go full circle.

In the meantime, your mortgage company will be advised you no longer have coverage and they will take out a single interest policy (covering them) on the property. And you get to pay for it. It's pretty expensive.

The roof problem doesn't seem so bad now, does it?

What I don't understand is why, if she's had "nothing but trouble" from this insurance company, has she stayed with them for 20 years! Unless it's because they're the cheapest...which is a bad reason.
