Hi, quick question I am three months pregnant and need to have foot surgery, in the next few weeks, can I go out on disability and maternity leave within the same year?

The fact of pregnancy, under California law however, is NOT a disability. An employer may treat you like any other employee; and, that includes not giving you an "excused absense."
Keep in mind that you only get 12 weeks protected FMLA leave (at most, if your employer is covered by FMLA), so the more you take now, the less you will be able to take after your baby is born.
