I have a claim through an insurance company that has been open for over a year. I had twins 11/30/00 and during the pregnancy I had lots of complications with my lower back.

I had x-rays and a MRI. The MRI states that I have inflammed and
bulging disc problems. I recently went to an orthopedic specialist to determine if I should go back to work. The doctor examined me and said absolutely not. You can feel the swelling in the lower back and he says this is going to take time to heal. I am VERY LIMITED as to what I can do around the house. Pain killers are not working! (VICODINE TYLENOL #3 W/Codine).

I am on Medical leave and have notified my health department at my job and they said I signed up under long term employee paid disability and have what is called a continued claim. I have not received any benefits from my disability/insurance company since 12/01 because I attempted to go back to work in January and the pain was so bad my supervisor got nervous and told me to go home. I went straight to the doctor and they advised me not to go back and sent me to an orthopedic specialist. The Orthopedic advised me also to stay off from work and continue on disability.

My disability/insurance company says they will not pay unless my condition proves to be worse. My doctor has authorized me to continue to stay on disability for now. What are my rights in this situation? Can my benefits stop even if my doctor is saying to stay on disability. The health department at my job is also saying I have the right to continue disability. I have a letter from my job's health department explaining this. I need help! Thanks!

When you returned to work in January, how long did you actually work before you had to leave? A couple of hours? A day? A week or longer?
