What is the name of your state (only U.S. law)? CA

When i was out on medical leave for surgery, my job paid me disability benefits. Now that im back to work, my HR rep came to me and said that they overpaid me by more than $1000. That they will take it out in 1 lump sum or 2 payments directly from my check. Is this legal? They want me to sign an agreement to 2 pyments but i dont agree.

They can request the overpayment to be paid back, however they cannot reduce your pay to below minimum wage.

$1000 is a lot to be overpaid. Did you know you were being overpaid?
