What is the name of your state?West Virginia ..Been in the court system for one year and still not released.
there is to much to write so will just give short sentences on the problems

My son's school did not follow his IEP.
The principal had my 14 yr disabled son arrested for brushing up against him.
We have the transcript of where the principal lied under oath about my son
My son spent 100 days behind bars, a lot of that in solitary confinement and without schooling.
Being disabled the pressure was to great and he tried to commit suicide while in solitary confinement
He is still in placement after almost a year.
My son will never be allowed in the public school system in our area.

Filed disciplinary action on his court appointed attorney
Hired an attorney and Judge called him and he then sent our retainer back
requested another court appointed attorney for our son...it was denied by the Judge.
Also put in order for my son's court records and that is denied also.
Help!! We live in a small town and they all come together to get what they want

What is the exact nature of your son's disability. Diagnosis?

Why are the principal, the judge, the police, and the lawyer all doing this to your son?

What did he plead guilty to? Or did he have a trial?

I am new and do not know how to reply to each one of the post that I got so I will try this:
To seniorjudge & rmet4nzkx:They charged my son with assault. I have the papers where the principal signed and they say that my son brushed up against him and he was tired of him.
After my son was sent off there were 5 more within an eight week period that the Principal had sent off. They get rid of a lot of their (disabled) or difficult students and still get the grant money for the programs.
A Christian attorney said that they clog up the court room with them every Juvenile Day.
The main reason that they are all working together is because I was very vocal about what they were doing.
Several of them lied in court under oath and I pointed this out, one being the JPO and I have PAID every since.
Keep in mind that I live in a small town so if you tick one off.....
His court appointed attorney told my son that if he did not sign a plea agreement saying that he assaulted the principal then he would get sent off for 4 years to the worse facility in our state. She said it was already signed and he would go so, he signed. We were livid and very vocal about this and after we filed papers with the disciplinary council we could not get rid of her and she has come against us to our face and behind our back.
I have dared to stand up to them and you just don't do that in our little town.
An attorney told me that the out come of the hearings are decided before the hearing.
We have papers where my son had a hearing on the 14th. the order was signed on the 13th..go figure.....

OK so you are saying your son signed a plea agreement underess and never had the scheduled court hearing where he could confirm or not that he signed the agreement of his own free will. How old is your son, what is his diagnosis, is he conserved? are you his guardian or rep payee?
