How much is the married non-custodial parent responsible for when the child has a documented developmental disability? The custodial parent is claiming that she needs additional monies for private school, but its my understanding that the government pays for education of disabled children. Secondly, now that we are married with a newborn, how is the first child's support affected? The custodial parent does not pay a share for childcare, healthcare, or educational expenses at this time [the child is 7 years old]. My husband was never married/lived with to his first child's mother.

As far as responsibility....If this child has a disability and needs special attention I don't think there should be ANY reason to complain or neglect that child from what he/she needs to live a normal life. Your new child will not affect the child support, as your husband knew about the child and knew that the financial obligation was there before deciding to support another child. As far as legally what you need to pay for, I'm not sure. But morally, if that child is disabled and needs accommodations I can't believe that there would be any questioning or denying in a situation as such. Look over the custody papers to see if bills are shared 50/50. If so, pay up. If not, prepare to go to court because I'm sure the Mother will press this issue as accommodating a disabled child is quite expensive on one income.
