What is the name of your state?arkansas: i am asking this for someone else, my niece and her husband are having marriage problems and she is talking about divorce. the thing is he just started getting his disability checks for his ex jobs insurance company and they are paying him pretty good each month. what she wants to know can she sue for child support from him? because he told her that she could not get a thing from him, that it was the law that you can't sue a disabled person. and they have three children all under the age of ten.

Why is she taking legal advice from her husband? She should consult an attorney but I do not believe that the fact that he is receiving disability stops his obligation to support his children.
