discharge questions and stuff

What is the name of your state? WA

My meeting was originally suppose to be December 16th 2005, but was moved to December 23rd 2005. My attorney says my discharge date is February 14th, but doesnt one have to wait 60 days from the 341 meeting? 61 days from our meeting will be feb 24th. Does that sound more like it--or should i just listen to my attorney, he does know more about these things than i do...

I just figured this out recently and we are getting ready to move out of our apartment and into a new one. The manager knows we filed for bankruptcy and was gonna run our screening on the 15th of february, the day after what we thought was gonna be the discharge. Do i have anything to worry about because we gave our 20 day to vacate to notice and have to be out of this apartment feb 28th at 12 noon. If she runs the screen on the 25th, that cuts it real short. What should i do?

Your discharge will be 60 days from the 341 meeting. But the trustee still has to close the case which is a different matter.

I don't know what you mean by, running a screen. Do you mean credit? If so, it will take a while before that shows up on your reports. In any case, if they already know about your bk, why would they care?
 
The bankruptcy showed up on my credit report almost immediately after I filed. Your credit report should already indicate that you've filed, on at least some of the charges.

I don’t understand the screening question either, if the manager knows you filed bankruptcy, what exactly do they think they’re going to see the day after discharge?
Which BTW- while technically you’re discharged 61 days after the meeting, you probably won’t get any paperwork, in hand until, about 30 days after that.
 
so in other words, if i waited the day after the discharge, it still would not show on the credit report as discharged, correct? I think this is what they are worried about. Us moving in this apartment and not paying rent and including it in the bankruptcy, which sounds pretty stupid in my opinion.
 
From what I've read on here it's not uncommon for the credit bureaus to take a few months to report everything correctly. Some only update on a quartly basis.

So maybe you can tell them that, b/c I'm pretty sure that it's not going to be what they're looking for the day after your dicharge. You more than likely won't have your discharge letter in hand for another month or so- so maybe you can just show them the paperwork regarding your 341 meeting and that your case is in the middle of discharged, you're just waiting on the paperwork.

I guess you can just try to reassure them that no post petition debts can be included.

Thanks for that info. My 341 was December 6th and have been waiting for it to show up any day. More like early March...
