disclaimer & insurance question

What is the name of your state? Iowa

My sister and I are considering making and selling swings used for home occupational and physical therapy programs. These swings would be used mainly by children with autism or sensory integration dysfuncition under the supervision of their parents. We would most likely sell them via a web site or on ebay and some locally through support group contacts. We are concerned with liablility if the items are hung or used improperly or God forbid should break. (of course we will be doing lots of strength/durability testing before we begin selling) Will we need to purchace insurance? Should we write a disclaimer? Do we need a lawyer to write a disclaimer that is legal? Thanks for your input.

Not to be harsh, but if you are asking these questions, you need to do a lot more research before you jump into this. Of course you'll need insurance, unless you want to risk your home. And it's very hard to disclaim liability when you are a supplier of goods, and you cannot disclaim liability if something breaks. And yes, you'll need a lawyer.

You will need to have nondisclosure statements made up for anyone who you involve in your venture....even the attorney you choose to help you.
