I bought this house on 8/1/10. I was aware that there were things that needed repaired such as there were a few holes in walls, the carpet is old, the deck needed repaired. All of those were listed in the ad and disclosed to me. There were a few things I was assured verbally were in excellent condition new roof, new sprinkler system and the air conditioner and furnace. When I looked at the house, every time the seller went on and on bragging up the great a.c and furnace. It was July and the A.C was really cold every time I looked at the house.
The day I signed the papers, the A.C. stopped being cold. It was 105 out side and 110 in the house for the entire month of August while I did the other repairs. I had the A.C. condenser coil cleaned. It blew more air, but it wasn't cold. Then this week,mid- October, it is getting colder, so I tried to turn on the furnace. Wouldn't start.
I called a furnace repairman and he says the furnace needs replaced. The coil and blower were completely plugged with hair and dust. The wiring to the high limiy switch had been jumpered so that the furnace would run, but if the temperature was too high it would not turn off and the house could have burned down. Because the furnace was run at too high temperatures and with a clogged coil, the heat exchanger might be cracked. Fan moter is faulty. It cost me $850 to get the coil cleaned and the blower cleaned. And the Hi-limit switch rewired correctly. More importantly the house could have burned down with me and my son in it. And the furnace still needs replaced. I just can't afford it.
The repairman also checked the A.C. The A.C. has a bad service valve and it will cost at least $800 to fix that. In its condition, it would leak out in a day. That's why it worked right up until I bought the house. It is obvious he just charged the unit with freon every time I was coming over to keep it cold, but I don't know if I can prove it.
Can I make the seller pay for the repairs, since he deceived me? I don't know about the A.C.. He did promise verbally that the A.C. was new and in excellent condition. I just don't know if he wrote that in the contract. But the furnace was tampered with to make it run. He damn sure didn't tell me about that. That surely is illegal.
He did list those other aesthetic problems that needed repaired. But nothing about the furnace or air conditioner being defective.
I did not have an inspection. I know that was stupid. But I still don't think that makes it okay to sell me a house with a dangerous furnace.
