I received a letter from collector attorney for credit card debt of
about $2,ooo, along with a copy of judgment signed by judge,
and a Discovery questionaire with the caption: Civil Action,
Certification.
The letter stated to complete and return Discovery questions,
and to contact their claim adjuster to make payment arrange-
ments.
They further said they could compel my attendance according
to Court Rules to answer these questions.
One of the questions was: do I have a bank account, and the
name of the bank.
I have 4 bank accounts with a total of a few hundred dollars.
I am trying to keep these accounts by maintaining the minimum
balances, because I understand from other posts that I may
have a hard time getting bank accounts after I obtain a bank-
ruptcy discharge.
If I give them the names of these banks, will they remove my
balances and close out the accounts ?
There are questions about my employment, and do I own a car.
I am unemployed and have no car. Does this make me "judg-
ment proof", where the Court cannot enforce judgment ?
The Discovery Questionaire was not part of Court Order, so do I
need to return to attorney ?
I have other credit card debt, so I may have to file Bankruptcy
at some later time, but this is the only judgment I have.
