Does U.S. law permit discrimination of L Visa workers transferred by employers to the U.S. Is denied access to employer's pension plan on the basis of residency status national origin discrimination? EEOC says no. If Employer transferring citizens of other countries to U.S. then ignoring terms of transfer isn't the fraudulent transfer discriminatorily motivated, knowing that transferring the worker means they will be denied access to the pension plan based on the fact that the residency status in the U.S. means exclusion.
