What is the name of your state? AL

I am trying to figure out how to go about filing a small courts claim against a seller on eBay. I recently purchased an item from them and it was damaged during shipping. I assisted the seller in filing an insurance claim with UPS and they issued him a refund check. Essentially the seller has now been paid twice, once by me and once by the UPS insurance claim. He has since refused to issue me a refund for the damage. Being that the seller is in VA and I am in AL I'm not sure how to proceed. Any information would be greatly appreciated.

How did you pay? Might be easier to dispute the payment.
You would have to go to his state to sue.

I paid with PayPal but have missed the deadline for filing a claim through them. If I decided to sue can the process be started on line, via fax, or do I have to go to his local court house and file in person? Also in situations such as this what is the likelihood that I would be able to recover my money, and since I am having to take it to court, my court fees and traveling expenses? It really does PAY to be a criminal doesn't it. It seems that the legal system has made it so hard to go after someone for something like this that most of the time it's not worth it so the criminal gets away with it and the honest people suffer.

Thank you for the advice about a charge back but unfortunately it was an instant transfer from my bank account.
