I bought a Kirby vacuum cleaner on 12/19/01. The salesman was here from 6:30 P.M. until 12:15 A.M. He did not act like he would leave until I bought the vacuum. I found out a week later that I had only 3 days after purchase to cancel the contract. I was not told about this 3 day limit and was not given a notice to rescind. They offered me $150 for my existing vacuum and this was not honored on the contract. I was told that if I had a problem with the Kirby to just call them and they would be here either same day or next day for sure. I had a problem with it approximately 3 wks. after purchase. I called them on Thurs. and did not get any return call. Finally, on Mon. I returned the vacuum to the Kirby store and told them I don't want it and left it there. Now the finance co. has contacted me and tells me I have to honor the contract I signed or they will probably take me to court. They also said Kirby will probably drop off the vacuum on my front porch. The finance co. also stated that they could put a lein on my automobile. I do not want the Kirby vacuum - it is too heavy for me (I'm a senior citizen), and too complicated for me to operate. I also do not want to pay for it. Do I have a recourse to this problem?
