Dishwasher missing when we moved in.

I recently moved into a new apartment. When we came to look at the apartment on 2 occasions before moving in, there was a dishwasher. When we were moving in, we noticed that the dishwasher was gone, and the refrigerator was in its place. Also, the cabinets around where the refrigerator used to be were gone.

We asked the LL what was up and he said that when he tested the D/W it was broken and decided to move the fridge in there instead to "open up space" in the kitchen. He also mentioned it would cost too much to buy a new D/W. I said something along the lines of "OK" and resigned myself to check the lease later.

I should mention two other things:

The lease includes:

The apartment includes the following appliances for the Tenants use:

a. Washer
b. Dryer
c. Stove
d. Refrigerator
e. dishwasher

Four days after signing the lease, the LL put the house up for sale. (This might explain why there was no application process or credit check, and why he doesn't want to spend money updating it.)

All in all the LL seems like an affable guy, and I don't want to start off on the wrong foot with him, but I want a friggin' dishwasher.

Any ideas how to get what I want and not cause bad blood?

I would be more concerned with being charged by the new owner for a dishwasher that was never there. You should get your landlord to sign off that the DW was not present when you moved in.

Keep all your communications with the LL who is selling in written form sent via certified mail Alas is correct you need to get this taken care of so you are not blamed for it being missing send your LL a letter stating the obvious , that your lease includes a dishwasher and remind him that your conversation with him was that he removed it and changed the lay out of the kitchen , then decide how bad you want one? you can remind him the lease promises you one or you expect to get from him a amendment letter to attach to the lease stating before time of occupancy the dish washer had been removed by him and the lease should not have shown it to be included. Keep copys for your records Inc the certified mail rct.

**A: great idea or ask that one be installed. Or T can serve as the dishwasher.
