What is the name of your state (only U.S. law)? NY

I was in a Nursing program (BSN) and was dismissed with only 3 classes remaining to complete the curriculum. The rules are get lower than a C+ in 2 classes and you are out. During my time at that institution MANY students didnt meet this citeria but were still allowed to continue in the program. Every semester a student shows up with a lawyer for unfair dismissal. During my semester more than 50% of the class was failing and even after their 12th hour curve alot of students still failed. 3 professors were teaching 3 sections of this course during my last semester, and after is was all said and done one professor who was with the university for years, quit. Another who was teaching that course for years opted to not do so anymore. Many students who failed more than 2 courses are still in the program or have even graduated. One student in particular who appeared with a lawyer failed a course then failed another and was still allowed to attend graduation before even repeating either course. I just want to be treated fair and I dont think I have been. Can you tell me if I have a case or not.

It seems to me that you have been treated properly according to the rules. It also seems to me that the school is willing to negotiate with those that have legal representation. As such, the logical course of action would be to obtain legal representation.

I would suggest that you find one of the attorneys that had success in having another student reinstated in the same or similar circumstances.

May I also say that I hope that neither I nor any of my loved ones ever finds themselves under the care of a nurse who only remained in the nursing school program because she hired a lawyer to force the school to take her back after she failed multiple course. And yes, I'm talking about all of your classmates who found themselves in this position as well as you.

The reason nursing programs have minimum grades is because there is no point to letting you graduate if you won't be able to pass the Nclex. And research shows a direct relationship between the grades you get in class and being able to pass Nclex. It's not just because they picked an arbitrary number. Find another program to apply to.

Well, if she wins, she won't have to worry about getting hired anywhere.

If she loses, I guess she can learn to flip burgers or hope that daddy will support her.

A normal person might have just taken the course again and tried to learn something from it.

Sadly I think we're in the same generation. Fortunately not everyone in this age group is an idiot.
I know you might all be ubber-sick of hearing this but!! :p My kid is not a self-entitled brat. I believe that there are other members with twenty-somethings that are self-sufficient. As odd as it seems? IT IS possible!! :)
