Over 2 years ago I bought a timeshare in Orlando, FL. with my girlfriend. Upon buying it they recommended that we each bought every other year so that there would not be a problem later on. My partner takes care of all the bills through her account. For 2 years there was no problem with them accepting payment on my account through her with my payment coupon included with the payment check and account #'s written on them. Then one month they sent me a letter saying I did not pay. I called them and they said they made a mistake and they would fix it. The next month she had paid a $1500.00 payment with $120 going to the bill and the rest going towards principle. I then got another letter saying I did not pay for that month. I called again and they said they made a mistake. That they put the total $1500 towards principle without taking out the payment and that they would fix. To make sure they did not do it again I followed up on the next month and sure enough they did the same thing. I called a manager and he assured me that it would all be fixed with no late fees applied. He faxed me my payment history and the late fees are still on there. He will not answer the phone and the fax number he sent me the forms through is a disconnected number.
Not only is this the only problem. The representative that sold us our condo described the condo as a townhome with an upstairs. That was what sold us on it since we live in apartments and always take the top floor because we do not care to have people walking on top of us. She said we could not see the actual condo at the time of buying because it was occupied, but assured us verbally that that was the layout. Upon staying in our unit we learned it was only the bottom layout with another unit on top. We told her about it and she said she was sorry. She made a mistake about the unit #'s. I asked how she could fix it and she said that she would put us on a list to trade our unit for the one we thought we bought, but will not give us anything in writing. I have emailed her and she will not respond to the email - with the email she gave as a hotmail.com account - which seems very unprofessional.
I am trying to build good credit and I cannot get them to remove the late fees from my payment history which is entirely their fault. I desperately want out of this contract - they have not held up to their part of the deal.
CAN I get out of it?
