disputing arrears and old dismissed charges

What is the name of your state? NJ
If arrears where decided by judge and calculations where done by judge both parties signed papers with judges. Now ex is deciding he wants credit for non child related items prior to support order being established,so he can lower his amount and has since also made it a point not to apy toward arrears and $amont now is above arrears amount which was calculated in January of this year, Is his lawyer just wasting courts time and lawyers fee for me or can they honestly be overturned?
Next what is the likly hood that ex can go from 4 hours once a week to EOW and two weeks vacation. With restraning order in effect . Dv classes order for him to attend and he refuses to go.
New incidents have occured that chidl should not be in any prolonged company of father he puts child in jepoardy and reckless wwith child saftey.
We have never lived toghter nor married. I have always been full time caregiver.

Aldso forgot one other thing he keeps including false charges that he dismissed in his paper work. He filed these false charges to muddy the waters as prosecutor said as to get police harressment charges dropped if I aske them to. Prescutor encourged me to do so to maybe start with a clean slate and had hoped that would happen since it was there feeling he is the tit for tat type. Unfortunatly I did this but the harresment still continues. Now in other forms which is harder for me to prove..

I don't believe he can get credit for anything he has bought, paid for, etc. before the child support order was put into effect. Anything that was done prior to a child support order is considered a gift, and if this could be done, I would assume every non-custodial parent out there would be doing the same thing. I would think he and his attorney would be just wasting time and money, because if he really wanted to make himself look good in front of a judge, he would have attended those classes. How long has the restraining order been in effect? I would assume he would be able to have EOW and two weeks vacation if he went to his classes. I had a restraining order out on my ex and once it was dropped, he has EOW and two nights during the week from 5-8. My son is 3, and we have been doing this since the baby was 6 mos. I really didnt get to your second post. Are you saying that the restraining order has been dropped? If so, his chances of getting EOW and vacation time are great. How long ago did you have the restraining order dropped, if indeed you did drop it?

The restraing order is still in effect. Iam not comfortable in dropping it. There have been other incidents that force me to sell and move from there because of harressment and also reckless behavior on his part. Went to court today he was a second no show for the probation enforcment hearing bench warrent has been placed now. So he will have to explain why he chooses not to contribute in support as well as expalin to them whey he should get credits prior to support oder. When the sherriff comes to get him I expect more problems he does not take kindly to being told what to do................

That is definately a bonus to you that he was a no show! I know it is not helping matters for you, since he is still not paying you, however, if they pick him up, he will have to pay a portion, and at least you will get something! Maybe this may scare him enough that he will start paying you in a timely fashion. When is your next court date? Do you qualify for legal aid? I know my girlfriend just got legal aid for custody, child support and visitation. We live in Cumberland County, maybe I could give you some numbers! Good Luck!

No Iam not in south Jersey. I make too much for legal aide. as a matter of fact because I work 40 week and he chooses not to he was inputted an income. But I still am liable for 70% of the total nut,. Don't have a new date yet but Iam sure it will come knocking on the door soon enough. According to hearing officer today he will be liable for total amount or he won't be leaving. Funny part about it if he had done what I asked which was not getting us into the system we should have been able to work things out but he choose this path and making harder on all involved as well as costly. All I keep seeing is the college fund go out the window because of the nonsense he keeps generating ,and he isn't winning on the topics either. Go figure???
