What is the name of your state? Texas

My wife is the successor trustee of a bypass trust created by her father's will. Her mother has passed away also, so it's time to distribute the real estate owned by the bypass trust to the beneficiaries.

Does my wife simply ask her attorney to prepare a trustee's deed naming the beneficiaries? Is it customary to list the beneficiaries as tenants in common? What is the name of your state?

My response:

Her attorney will be in the office at 9:00 a.m., sharp, tomorrow morning. I promise.

Not likely, considering tomorrow is a Saturday. Do you have anything useful to contribute?

Your attorney can answer all of your questions, since it is most unlikely that a Texas trust law attorney will be reading this message board. Were you implying that your wife's mother was the original trustee? If she wasn't, then your wife has no authority to be doing anything with the trust yet if there is another primary trustee that is not her mother.
