Recently until midnight, the Super of our building was continuously making noise: runnning, moving furniture, exercise, dog barking, kids jumping on the floor late at night. I can tolerate this once in a while but it has been on several nights. I think this is inconsiderate to other people. I asked them to reduce the noise level, but they refused. One night, I banged once or twice on the ceilings. The noise stopped then started again. When I told the guy that it is illegal to make noise after 11:00pm, he said only loud noise like music. Can you please advice me on the correct level of noise a tenant can expect and if I have any rights against the Super as I feel he is violating my right to enjoy mny apartment.
I am a sub-tenant in New York.

Check your lease and see if the landlord is required to preserve your "right of quiet enjoyment" against other tenants in the building. If yes, the landlord is in breach if s/he does not control the super's behavior. Even if there's no such clause, file a complaint with the landlord/owner. Maybe the situation will improve.

Also, check the noise ordinances and see exactly what is prohibited. You can sue the super for nuisance.
