What is the name of your state (only U.S. law)? Ca

Recently my 64yo friend was arrested for 23152(a) with blood test results showing .17 BAC. Prior to this he had an immaculate driving and arrest record and he would prefer to keep it that way, especially since he is a private pilot.

Does he qualify for a diversion program of some sort that would make this charge go away? I've tried investigating Prog 25 and SB 1000, but that info usually is dealing with illegal drug ingestion.

Thank you for helping us out!

His attorney would know if any diversion is possible, but I do not believe there will be. Unfortunately for him, with such a high BAC his offense is aggravated and will be hard to plea down, either.
