My husband's divorce was final in December of 1996. His ex-wife moved to Kansas City Mo. in 1995 with his daughter. Before she had moved debt had incurred during the marriage and during the separation which included medical bills for the birth of their daughter, electric bills, credit card debt as well as an auto loan that went unpaid. Because his ex-wife had moved out of state, the creditors held my spouse responsible for payment. We did pay off all of the bad debt that came to a total of $4,800. Since the divorce had no mention of debt during the marriage, can we sue his ex-wife for payment of 1/2 the debt or is it too late? Also the auto situation was that his wife took the car to Kansas City with my husbands permission and did not make the payments. Once again the creditors could not find his ex-wife, thereby going after my spouse. We are looking into whose name is on the auto loan. If she co-signed, would'nt she be responsibile for 1/2 the debt. Or if she did not co-sign, and took the car, is she responsible for 1/2 the debt?
Do we have a case or will it be wasted time and money to persue this? thanks for your time and valuable advice
