What is the name of your state? Washington

I was married May 21, 2005 and it's just barely a year. Husband has asked for a divorce. We started living together in 2002 and I was working, he found a job in Sept 2002. He only was taking out 8% to put into his 401K, I was putting 20% and NOW he wants in the divorce settlement $$$$ all the way back to 2002, not just the year we've been married.
Is this legal to do or what do I do, because I can see the year we were married, but not all the way back to 2002???? HELP!

No...he can't get anything that accrued prior to your marriage....stand firm on that issue, and if he has an attorney you probably need one as well.

Actually judges can go back to before a marriage if good reason is found to believe that a marital relationship began before the ceremony. So while it is highly unlikely it IS possible. I definitely agree she needs an attorney and I also agree that she better stand firm but still have reasons why it should not go back to 2002.
