Just to clairfy. I got married to my husband in May 2000 in India. I accompanied him to CA as a visitor on 29th May(the visa was sponsored by a family friend of my parents & not my husband). During my stay, he did not apply for a permanent visa status for me. Instead from a week into my marriage I was treated as a servant and verbally and physically abused by the entire family including of mother, father & brother in-law. I was sent back to my parents in July 2000. I returned on my own accord and at my own expense to my husband in September 2000. Then onwards the treatment became worse. I was looked upon with great suspicion and treated badly. I was physically and verbally provoked and abused by the entire family all the time, with no support from my husband. He taped my conversations with people of the phone, even to the extent of taping my conversations and disagreements with himself, by carrying a dictaphone in his pocket.
I am not after anymore compensation than is legally due to me for being put through this immense mental stress and emotional upset.
I have now been tricked and lied to and sent away to friends in Canada and have learn't that he has filed for a divorce giving me no alimony. Before I left, he lied to me and said he would call me every weekend and will come and see me after a month and that I will return to him after three months and we will get back together.
All I want to know is do I have a basis of fighting for my rights and in the eyes of CA law, have I been used and abused and played dirty with. How can I get the most out of this breakup to compensate me for all the mental and physical torture.
He has threatened me that if I do not sign and return the divorce papers then I will be at fault and the divorce will go through any ways.
I understand it has only been 7 months since I got married, but in no way has it been treated like a marriage, just a contract and I have been kept in the dark. I don't know what his intensions were. Since he is a US citizen, he obviously, has been aware of his rights and has played dirty with me and ruined my life.
Please do let me know what is my right and what course of action I can take sitting in Canada or India.
