Hi, I have been married for 7 years (7 very trying years!). My husband has alway been very mentally abusive and just recently this turned to physical violence. We have two young children together and they have been witness to some of the violence and alot of emotional voilence. He has used the kids against me and put them in awful situations. Anyways, the last time that he hit me I told him that I was going to leave and that I would be taking the kids with me. In his way of panick, he went and filed for divorce before I could. He says that now I can't leave with the kids. I did not call the police when he hit me last because our marriage counselor that we have been seeing for 1 1/2 years made an agreement with him that he would leave for 48 hours and enroll himself in a Batters Education Program. He did leave for the 2 days but he has not gotten into the program yet. My main question is..... will his voilence help me in the divorce to get what I want? Especially.... will it help me to become the custodial parent?
