I am living in Washington State. My divorce was in Kentucky years ago. In the divorce decree my X was to sell or refinance the house so I can have my VA loan back for my own use. She has to failed to do anything in the time frame allowed and is 3 1/2 years passed the deadline. I have tried to be give her plenty of time. What is my recourse to get my VA loan back as agreed to in the divorce decree? Also if I have to take legal action, can I do it with a Washington State Attorny or does it have to all be done in Kentucky?

My response:

You need to take legal action before the Statute of Limitations runs out ! !

You must take action in Kentucky because that's where the property is located, and that's where there original orders were rendered concerning the property. Only a Kentucky court has jurisdiction in this type of a matter, because of the property.

I am in the process now to take action. I got online with the Q&A Law Forum this afternoon. They were a great help referring me to online lawyers. I am going to have my Lawyer here in Washington State send a letter to see if she will do what I have asked her to do in the past without any further legal action. I think I have been more than fair in trying to give her time to get her end of this transaction taken care of.
Thank you so much for responding. It did help to confirm exactly what I had already thought. I, however, did not realize that there was a Statute of Limitations involved. If she doesn't respond in a timely manner then off to Kentucky the issue goes. Thanks for the help!
